Neptune Tony Tool Rental Agreement
This Neptune Bearing Removal / Installer tool (“Equipment”) or Tony Tool Rental Agreement (“Agreement”) is made and entered into this day, which will be stated on the Paypal Transaction, between Target Security LLC (“Company”) and (“Customer”), which will be stated on the Paypal Transaction.
Equipment Rental. Customer hereby agrees to rent from Company the Neptune Tony Tool (“Equipment”), Customer agrees to pay the deposit of $406.00 + $79.00 for Bearing and seal kit via Paypal. Once the Equipment is returned in satisfactory condition the remaining deposit of $320 will be refunded via Paypal usually within 2 business days. You also certify that you are a Neptune Owner and you are replacing your own Neptune Bearings and that you are not a Appliance Service Technician replacing Neptune bearings for a service fee. If you are a Service Technician you can purchase your Tony Tool and Bulk bearings from http://www.neptunekits.com. If it is discovered that you are a Service Technician performing bearing replacements with a rented tool then Company reserves the right to withhold the entire deposit refund.
Maintenance and Alterations. Customer shall keep the Equipment in good condition and shall only use the Equipment for its intended purpose. The Customer shall not change or alter the Equipment without Company’s prior written consent. Violation of this Section by the Customer could cause the deposit to be withheld to bring Equipment back to original condition then, if any, deposit will be refunded.
Terms and Termination of Agreement. This Agreement shall continue in full force and effect until Customer returns the Equipment to the Company. Customer agrees to send Equipment back as soon as possible. After ten (10) days from customer receipt of Equipment there will be $90 fee assessed against the deposit for extended rental.
Liability. During the term of this Agreement, the Customer shall be solely responsible for any loss or damage to the Equipment. The Customer shall also be solely liable for all claims for personal injury or damage to property, arising, directly or indirectly, out of the use of the Equipment. The Customer hereby assumes and shall bear the entire risk of loss for theft, damage, destruction or other injury to the Equipment from any and every cause whatsoever. No such loss or damage shall impair any obligation of the Customer under this Agreement, which shall continue in full force and effect. In the event of damage to or loss of the Equipment (or any component thereof), the Customer shall pay the costs to bring Equipment back to original Equipment, which will be subtracted from the deposit refund.
Payment; Required Paypal Information. A valid Paypal account is required for the Equipment rental and other charges contemplated by this Agreement. Customer hereby authorizes the Company to withhold finds from the deposit to pay for the charges covered by this Agreement. Customer hereby certifies that the information provided by Paypal is true and correct, including Customer’s address and email.
Warranties. THE COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY NATURE, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY REPRESENTATIONS OR WARRANTIES WITH RESPECT TO THE SUITABILITY, DURABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, INFRINGEMENT, MERCHANTABILITY OR INTENDED USE. IN NO EVENT SHALL COMPANY BE LIABLE FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES INCLUDING LOSS OF PROFITS, RESULTING FROM ANY FAILURE OF THE TONY TOOL OR ANY PERFORMANCE BY COMPANY.
Entire Agreement. This Agreement constitutes the entire Agreement between the parties on the subject matter contained herein. This Agreement supersedes all prior oral or written agreements between the parties. This Agreement may be amended only as mutually agreed upon in writing.
I would recommend purchasing shipping insurance when returning the tool for $400 to cover the tool if it gets lost in transit.
